WHISTLEBLOWER DIRECTIVE REQUIRES NUMEROUS COMPANIES AND MUNICIPALITIES TO IMPLEMENT WHISTLEBLOWING SYSTEMS

On December 16, 2019, the Whistleblower Directive (EU) 2019/1937 entered into effect. It is intended to bring the protection of whistleblowers reporting breaches of Union law to a uniform level throughout the EU. As a result, companies and, in particular, legal entities in the private and public sectors will be required to establish a secure reporting channel that encourages whistleblowers to report internally rather than turning to supervisory authorities or the media. The two-year deadline for member states to transpose the regulation into national law expires on December 17 of this year. It is therefore to be expected that a corresponding law will be introduced in Germany soon after the new government is formed.

ARE YOU AFFECTED?

All companies with more than 50 employees, as well as cities and municipalities with more than 10,000 inhabitants, will be required under the EU directive to implement an internal procedure for dealing with whistleblowers. If no internal reporting channels are implemented, whistleblowers will have the option, according to the EU Directive, to forward an external report to the relevant authorities - with incalculable consequences.
